The NHS: A possible money saver when it comes to care homes!!!
Did you know that the NHS can potentially save you a fortune if you, or a relative, are in a care home?
The courts have recently determined that if a person's needs are primarily that of 'health' care, as opposed to 'social' care, all care fees should be paid by the NHS. Only if the healthcare needs are incidental to the need for accommodation is there an obligation on the individual to pay.
How do you get the funding?
NHS funding is not means tested. An assessment of your
needs will be arranged with the local Primary Care Trust. Care
homes will often help with this. After the assessment has been
completed a decision will be made. If funding is not granted, an
appeal can be made to a panel of the PCT. Failing success, the
decision can be reviewed by the Strategic Health Authority, then
the Ombudsman and if the amount warrants it, finally the courts.
Reassessments can be arranged if the person's condition
deteriorates - in that sense a decision is never final. Claims can
even be made from the estate of a person who has died.
To maximise the chances of success, it is important to obtain advice at the earliest possible stage. If someone you know may have a claim or if you require further information or advice please contact Philip Martin-Summers at Higgs & Sons directly on 01384 342018.
