Support is key to rebuilding lives for victims of abuse

Trust is a vital aspect of any relationship between patients and medical practitioners. But when that trust is abused, the consequences can be devastating.

“The recent conviction of a GP for ten counts of sexual assault against four patients here in Dudley shows an abhorrent misuse of trust by the doctor concerned,” comments Alice Eastwood, a Solicitor in Higgs & Sons’ Clinical Negligence team.

“It is absolutely vital that the victims get appropriate support in order to help them move on with their lives.”

The case heard at Wolverhampton Crown Court concluded that Dr Rathore, a Dudley GP, assaulted his patients under the guise of “manipulative massage therapies” which left them frightened and traumatised. He would then proceed to personally contact them to ensure that any future appointments were attended.

Dr Rathore was sentenced to 12 years in prison for his crimes and has been struck off the register by the General Medical Council. Alice Eastwood continues:

“A conviction such as this is only possible because of the courage of the victims in coming forward to give evidence. Now the Court case is over his victims will begin the painful process of rebuilding their lives. Such abuse often leaves victims with psychological injuries and emotional scars, which need specialist treatment to optimise recovery.

“Unfortunately such treatment is costly and not always easily available on the NHS. The situation is further compounded by the fact that many victims of assault at the hands of a medical professional may have issues placing their trust in using NHS services. Access for victims can therefore be difficult, prolonging the pain and anguish of the situation.”

Higgs & Sons’ specialist Clinical Negligence team is highly experienced in supporting victims of sexual assault from medical professionals.

Alice concludes: “We work with victims to identify how we can best obtain the right level of support to help them rebuild and get their lives back on track. “Compensation can be an important part of a support package as it may help to pay for treatments on a private basis. By securing compensation you are given the power and choice over your own treatment, which can help with recovery and it is extremely important that people pursing such claims feel comfortable throughout the process.

“At Higgs & Sons we pride ourselves on not only offering exceptional legal advice but also guiding and supporting our clients at all stages of their claim”.

If you think you or a loved one may have been subjected to any form of assault by a medical professional and would like advice on your entitlement to compensation please contact Alice Eastwood via 01384 327373  or a member of the Clinical Negligence team in the strictest confidence.
