When noise becomes a real nuisance

In a rarely contested field of law, a London banker has won £100,000 in damages from her upstairs neighbours over the ‘intolerable’ noise of their young family on wooden floors.

Sarvenaz Fouladi, 38, sued her noisy neighbours claiming she had faced a constant bombardment of noise from the family-of-five above her £2.6million apartment in Kensington, West London. She said the children used the flat 'like a playground'.

Nyree Applegarth, Partner in the Dispute Resolution and Litigation team at Higgs & Sons, said: “This represented a substantial award, particularly for a noise nuisance case.

“Cases such as these are rare but it demonstrates that they can be successfully used to prevent someone from doing something lawful - if that action causes someone else a nuisance.”
