Cohabitation Agreements

There is a widespread misunderstanding of the rights of cohabiting couples on the breakdown of a relationship. For example there is no such thing as a 'common law' husband or wife. Such misunderstandings can result in difficulties in the event of a separation, such as how to treat property (whether jointly owned or owned by one party) where the other seeks to make a claim.

Our specialist advisers offer practical advice on the drafting of agreements between cohabiting couples to determine how finances, including solely and jointly owned property, should be dealt with in the event of a separation (sometimes referred to as 'no nups').

Cohabitation agreements can help to avoid the personal and financial stress of dealing with issues at a time when emotions may already be running high. Many consider this a form of insurance policy – one which we hope never to use, but providing security in the knowledge that it is there, just in case.
