Do I have a claim?

To succeed, you must prove that your accident and injuries were caused by someone else’s negligence.  This depends from case to case and also whether you have any supporting evidence, from say witnesses.  We will consider all of this when advising if you have reasonable prospects of success.

How do I claim?

All claims start by sending basic claim details to the other side's insurer for them to investigate liability.  If at the start we think your claim is not worth more than £25,000, all of our contact with the insurer is through an electronic portal.  However should the insurer dispute liability or if your claim is worth over £25,000, we do not use the portal and correspond normally with the insurer.

What is my injury worth?

To assess your injury we obtain a doctor's opinion on your injury and likely recovery.  In more serious cases, we will need to obtain more than one doctor’s opinion.  We can then fully assess the value of your claim with reference to what compensation judges have awarded previously for similar injury. This is why, without a medical report, we can only give you an indication as to the possible compensation awards.

What else can I claim?

As well as compensation for your injury, you can claim any expense or losses caused by your accident. For example this may be treatment, medication, travel costs, lost earnings, the cost of adapting or providing alternative accommodation or help you have received from others, even if it was unpaid.

How long will it take?

This can vary from case to case. It depends on when your injury improves and also the insurer's conduct and in particular whether we have to fight the case to court in order to prove your claim.  Straightforward cases can settle within 3 to 6 months of the accident, but others which involve more serious injuries can take much longer.

How do I fund my claim?

When you speak with us, we will advise you on the best way to fund your claim.  It may be that you have existing legal expenses cover.  However if not, we can help fund your claim with a No Win, No Fee agreement if we think your claim has prospects of succeeding, which means there is no financial risk to you if you lose.
